In 1996, The Supreme Court of India had declared that "Poker is a game of skill and not a chance." The SC has also passed the decision that no charges can be pressed on any individual for playing such games. Several other high courts of India have also stated that the Poker game requires play skills, and all are free to play this game.


Also, the High Courts of Karnataka has passed the law that no one can stop the players from playing Poker game. Based on these statements, Poker is considered a legal game in India. The International Mind Sports Association (IMSA) has also considered poker as a 'mind sport.' Poker is a game of skill for playing this game, and an individual should possess certain skills like psychological skills, good knowledge of mathematics and statistics, focus, and concentration. The Player first calculates the odds and guess the outcomes, and on that basis, bets are set. The winner is not declared based on luck.


Players from all states in India can Play Poker games online and offline, except few states like Assam, Orissa, Nagaland, and Sikkim. People from these states are not allowed to play on any Poker website, and penalties are imposed on the people if found playing Poker game. In Goa, if one wants to play a Poker game, then he can play only in brick-and-mortar casinos. Also, few states like Telangana and Gujarat have put-forth certain limits on the players. Players of these states cannot deposit or withdraw poker winnings as poker is considered a game of chance and not a skill there. Other than this, players have to pay the TDS of 30.3% if their winning withdrawals have reached above INR 10,000.
